Wills, Estate Planning & Estate Administration

Wills and Estate Planning

We all recognise the importance of having a valid Will. Despite this, finding the time to have a Will prepared is one of those things that can easily get overlooked in our busy lives. At PGC Legal, we provide advice about your Estate Planning issues and prepare the documents necessary to ensure that you and your Estate will be properly looked after.

Because every person’s circumstances are different, we listen to your needs and tailor your Will according to your specific circumstances and requirements. For example, some estates may benefit from a Will that establishes a Testamentary Trust so that the people closest to you maximise their inheritance entitlements.

We provide advice which is relevant and easy to understand.

In addition to preparing Wills, we can provide advice about other important documents which complement your Estate Planning and which can give you peace of mind about your future. These documents include:

  • Powers of Attorney
  • Advance Care Directives

Administering Estates – Grants of Probate and Letters of Administration

If you have been named the Executor of a Will, you may not know what your responsibilities are, or how to go about fulfilling them. Where the Estate owns real estate, cars or other significant assets, the legitimacy of the Will and the instructions it contains need to be proved before the assets of the estate can be distributed in accordance with the Will. In South Australia, the process of proving a Will results in the granting of a Grant of Probate or Letters of Administration (depending on the circumstances of the Will and Executorship). Grants of Probate and Letters of Administration must be sought from the Probate jurisdiction of the Supreme Court of South Australia. As an Executor, knowing how to go about applying to the Supreme Court to prove a Will may be a daunting prospect but, in most cases, a necessary one.

At PGC Legal, we are experienced in the administration of Estates and dealings with the Probate Registry of the Supreme Court of South Australia. We can clarify the processes for you, prepare and lodge all necessary documentation, communicate with official asset holders such as banks and the Lands Titles Office, and prepare all necessary documentation to administer the instructions in the Will.

When the time comes to administer a Will, PGC Legal can assist you.
